Texas Foster Care Tuition Waiver Legislation

Official Link: DFPS State College Tuition Waiver (Texas Education Code § 54.366)

How it works: This state law provides a full exemption from tuition and many fees at Texas public (state-supported) colleges, universities, and technical/vocational schools for eligible current and former foster youth and those adopted from DFPS care. It is one of the most generous programs in the nation and serves as the model for American Foster Futures' state-by-state reciprocity and tuition waiver advocacy.

Eligibility: You generally qualify if you were in DFPS conservatorship on or after your 14th birthday, or were adopted from DFPS with an adoption assistance agreement. Other qualifying categories exist. DFPS can provide official verification of your eligibility.

Key Benefits:

  • Covers tuition + authorized fees (lab fees, etc.) for eligible courses that receive state formula funding.
  • No financial need or GPA requirement for the waiver itself.
  • Can be used at any Texas public higher education institution.
  • Recent legislation (HB 1211, signed 2025) removed previous age caps, significantly expanding access for former foster youth.
  • Once activated (by enrolling before the applicable deadline), eligible students can often use it for multiple degrees over their lifetime with no semester limit.

Note: Always confirm your specific eligibility and required documentation directly with DFPS and the college's financial aid office. Dual credit courses taken while in high school may also count toward activation.

This legislation is the foundation for our national push to expand similar tuition waivers and reciprocity across all states.
